The State of the Economy and ObamaCare...

The State of the Economy and ObamaCare...

Yes indeed. Just as some on the left are sounding the clarion call that ObamaCare is working in those states that have embraced it, such as New York and California to name two, polls are indicating that the overall national perception of ObamaCare is a net negative and even shows that some believe it should be repealed.

My own view is that those favoring drastic overhaul or repeal have it about right. In the rush "to do something" We the People ended up with a flawed law being shoved down our throats. This is not a partisan statement as I'm willing to bet (based on the number of democrats that are now balking) that many liberals are questioning the wisdom of passing the legislation they knew little about and whose leader, Rep, Nancy Pelosi (D-CA) said 'we have to pass the law to know what's in it'. ????? is all I can say about that gem of blind partisan faith and lack of reason.

As President Obama, and our First Lady embark on yet another campaign to sell the ACA (ObamaCare) I say why not let the damn thing meander its way into full implementation and after five or so years analyzing it's impact decide what we should have done. Of course that is assuming ObamaCare ruins the American healthcare system as many (myself included) think it will. But we could be very wrong. Soooooooooo, since we don't know (for sure), why not give the duly elected President of this Great Republic the unfettered opportunity to prove his signature legislation is right for America? Or, let it through the working process show itself to be the failure the republicans, libertarians, and some democrats fear it will be? Don't we owe the PresidentWE elected that opportunity?

ObamaCare at the two minute mark.

CBS News - A new CBS News poll finds more Americans than ever want the Affordable Care Act repealed.

According to the poll, 36 percent of Americans want Congress to expand or keep the health care law while 39 percent want Congress to repeal it - the highest percentage seen in CBS News polls. The poll also found a majority of Americans - 54 percent - disapprove of the health care law, 36 percent of Americans approve of it and 10 percent said they don't know about it.

The health care law is a chronic issue for the White House, CBS News political director John Dickerson said on "CBS This Morning." "There's an operational part to this, which is that the White House has got to get people to sign up for these health exchanges, particularly younger, healthier Americans, and so they are tactically running a campaign much like the presidential campaign, reaching out, using the techniques of that campaign to get younger people to sign up for these health exchanges."

Special Section: Health Care in America

The poll also found just 13 percent of Americans say the health care law will personally "help me" while 38 percent said they believe the law will personally "hurt me."

Dickerson said, "The feeling, basically, is, again, speeches are not going to change public opinion; this has got to start taking hold. People will start signing up and, the White House hopes, good things will start to happen once it kicks in, and that might turn around public opinion, but that's a ways away."

Open enrollment in the Health Insurance Marketplace begins Oct. 1.

Wauwatosa, WI - On Monday, Wauwatosa Police Detective Robin L. Schumacher, 38, was charged with two felony counts for misconduct in office and possession of narcotics and one misdemeanor count for theft in the access of $2,500. If convicted on all counts, Schumacher is facing up to 7 years in prison. Each felony counts carries a penalty of up to three years and the misdemeanor count up to nine months in prison.
Schumacher confessed to investigators that she had a drug addiction to pain killers that let her to steal drugs designated to be burned (destroyed) on July 11, by the Milwaukee County Sheriff's office. An inventory list of drugs confiscated for evidence and then marked for disposal indicated some of the narcotics were missing from the section designated for drugs awaiting disposal.  Det. Schumacher also used a key to get access to the restricted drug storage section to allegedly steal the narcotics.
Investigators placed surveillance cameras on July 16 and Det. Schumacher was caught going into the room and then taking plastic bags of drugs that were placed on a disposal marked box. She then took the box outside to her vehicle and when she returned inside the department, the box was empty, according to the criminal complaint.
When she was arrested, department investigators found drugs (40 pills) on her person and a key to the restricted evidence room belonging to another employee that was on vacation. She had gone into the restricted evidence room six times between June 11 to July 11.
Schumacher was placed on paid suspension and Wauwatosa Police Chief Berry Weber has notified city aldermen, that he will ask the Fire and Police Commission to terminate Det. Schumacher.
She has been in law enforcement for the last 21 years, according to Weber.
On Tuesday,  Det. Schumacher was in court and pleaded not guilty to the misdemeanor count and will enter a plea at a later date for the two other felony charges. She is expected back in court for a preliminary hearing on August 2.

Is it just me or does anybody else think these two guys are flakes?

TPM - According to Rep. Steve King's (R-IA) math, legalizing undocumented immigrants is untenable because for every valedictorian DREAMer -- immigrants brought to the U.S. as children -- there are 100 more who are carrying drugs across the border.

"Some of them are valedictorians, and their parents brought them in," King told Newsmax in an interview last week. "It wasn't their fault. It's true in some cases, but they aren't all valedictorians. They weren't all brought in by their parents."

"For everyone who's a valedictorian, there's another 100 out there that weigh 130 pounds and they’ve got calves the size of cantaloupes because they're hauling 75 pounds of marijuana across the desert,” he continued. “Those people would be legalized with the same act."

So, Representative King, where's the supporting proof behind your statement? Inquiring minds want to know.

Obamacare’s serious weaknesses driving even strong supporters away

Obamacare’s serious weaknesses driving even strong supporters away

Commentary by James H. Shott

Although Sen. Max Baucus (D-Mont.) only recently acknowledged that the health care reform bill he helped create – the Patient Protection and Affordable Care Act (ACA), also known as Obamacare – is a “train wreck,” most Americans suspected that at its creation.

Things are so bad that President Barack Obama, trying to prevent some of the disastrous results, did something he is not allowed by the U.S. Constitution to do: postpone implementation of part of the law by suspending the employer mandate until 2015 and leaving the rest of the law intact. The Executive Branch of our government is obligated to enforce the laws – all of them, and all of each of them – and does not have the power to choose which ones, or parts thereof, it will enforce.

The House of Representatives passed two measures delaying the employer and individual mandates for one year, with 35 and 22 Democrats respectively joining in those efforts, which Mr. Obama has curiously threatened to veto.

And more recently, one of Obamacare’s most devoted groups of supporters has jumped ship. In a letter to Democrat Congressional leaders, Teamsters union president James Hoffa, and the presidents of two other unions, said this: “Right now, unless you and the Obama Administration enact an equitable fix, the ACA will shatter not only our hard-earned health benefits, but destroy the foundation of the 40 hour work week that is the backbone of the American middle class.”

The law has already encouraged some employers to trim their staffs to fewer than 50 full-time employees to avoid the expense of the mandate, and in other cases to decide against providing insurance altogether, and pay a much cheaper fine.

Nevertheless, Mr. Obama declared last week that "the law is working the way it was supposed to for middle-class Americans,” and criticized House Republicans for trying to dismantle it.

Polling data from five different polling organizations from mid-May through July 13 shows continuing disfavor among Americans, with the disparity of opposition-to-support running from as little as 5 points to as much as 15 points, and the Real Clear Politics average of the five polls at 10.2 points.

According to the Gallup poll from late last month, 42 percent say that in the long run the law will make their family's healthcare situation worse, and only 22 percent say it will make it better. And 47 percent believe the law will make the healthcare situation in the U.S. worse, while only 34 percent say it will make it better.

Republicans also are criticized for offering no alternatives while trying to dismantle the measure. “Three years after campaigning on a vow to ‘repeal and replace’ President Barack Obama’s health care law, House Republicans have yet to advance an alternative for the system they have voted more than three dozen times to abolish in whole or in part,” Sunday’s editorial in The Washington Post complained. That ignores, however, H.R. 3400 - Empowering Patients First Act, introduced in 2009 before Republicans campaigned for and won control of the House.

And now there is another, H.R. 2300 – the Empowering Patients First Act of 2013. Its principal sponsor is Rep. Tom Price (R-Ga.), who sponsored H.R. 3400, and he has credentials for health care issues matched by few in the Congress. Rep. Price is also Dr. Price, a physician who actually delivered and understands patient care.

This measure allows patients, families and doctors to make medical decisions, not Washington, DC. That is an excellent place to begin improving health care. What a shame that wasn’t the driving factor behind the ACA.

“You can get folks covered, you can solve the insurance challenges, and you can save hundreds of billions of dollars in this health care system,” said the physician/Congressman, “all without putting Washington or health insurance companies in charge of those decisions that ought to be between patients, and families and doctors.”

How can H.R. 2300 – a bill of only 249 pages, less than a tenth the length of the monstrous Obamacare bill – accomplish this?

Rep. Price describes it as comprehensive legislation under which “every single American has the financial feasibility to purchase the coverage they want, either through tax deductions, or credits, or advanceable credits or refundable advanceable credits so that they can purchase the coverage they want for themselves or their families, not what the government forces them to buy.”

He says further that everyone owns their own coverage, like a 401k plan, so if they change their job or lose their job, they take their coverage with them, and it allows all of those with pre-existing conditions to pool together, giving them the purchasing power of millions so that no one person’s adverse health status will change the cost for anyone else, including that one person.

While H.R. 2300 has the great advantage of being properly focused on patients and physicians, trying to straighten out the voluminous failures of the ACA in one bill is a Herculean feat. Obamacare needs to be repealed in total, and as soon as possible, and then Congress must undertake a sensible approach to correcting the problems of the health care system without turning it over to the government.

The Detroit Detox
NO Government Bail Out For Detroit
A Commentary by J. D. Longstreet

***************

Of course, Obama will do everything humanly possible to bail out Detroit -- in one fashion, or another. There can be no question about it.

After all, Detroit IS spelled:  U-N-I-O-N .

There are a host of municipalities standing by, holding their collective breath as they wait to see what the federal government will do about Detroit.   IF the US government writes a check to Detroit, get ready.  The flood gates will open and, in the twinkling of an eye, the US Treasury will be bone dry -- or at least as dry as Death Valley in the middle of August.

In a letter authorizing Detroit's bankruptcy filing, Governor Rick Snyder, a Republican, noted a few problems that have contributed to Detroit's dilemma:

• The city's unemployment rate has nearly tripled since 2000 and is more than double the national average.

• The homicide rate is at historically high levels, and the city has been named among America's most dangerous for more than 20 years.

• Detroiters wait an average of 58 minutes for police to respond, compared with the national average of 11 minutes.

• An estimated 40% of the city's street lights didn't work in the first quarter of 2013.

• Roughly 78,000 city structures have been abandoned.

Consider this:  "The combination of lost auto industry jobs and rising crime rates prompted many middle-class whites and African Americans to flee Detroit over the past few decades. That exodus left behind an overwhelmingly poor and nearly 83% African-American population, making Detroit the nation's largest black-majority city."  SOURCE:  http://www.usatoday.com/story/news/nation/2013/07/18/detroit-files-for-bankruptcy/2567159/

Kevyn Orr, the city's appointed emergency manager, has said Detroit's  financial responsibilities -- in total -- could be as much as $20 billion.

In October of 2012, President Barack Obama said:  "We refused to throw in the towel and do nothing. We refused to let Detroit go bankrupt. We bet on American workers and American ingenuity, and three years later, that bet is paying off in a big way.”  That was then.  This is NOW.

"The municipal workers’ pension plans (that face 90% losses) will be bailed-out via the Pension Benefits Guaranty Corporation (PBGC)"
SOURCE:  http://www.theblaze.com/stories/2013/07/18/obama-flashback-we-refused-to-let-detroit-go-bankrupt/

The PBGC is a US Government Agency.  That means, of course, taxpayer money.

How could this happen?  Detroit is the largest city to file bankruptcy in US history.   Spending money you don't have is a very effective way to bankrupt anything or anyone.

Detroit tried taxing the rich, you know, the foundation of Obamanomics, and what did they get for their effort?  Well, a ride through the city observing the hulking multi-story -- empty -- factory buildings and the explosive unemployment rate should answer that.  THE RICH LEFT -- and took their businesses -- and JOBS -- with them.

Detroit has been circling the drain for decades.   The decline in the auto business and the population moving away was a symptom, not the cause, of the city's collapse.

When you cut through all the Bovine Scatology the answer is clear.

Consider this from an article by John Hayward at Humanevents.com:  "And let’s not dump too much of Detroit’s crisis at the feet of those automakers, because that corrupt Democrat Party elite spent the city into penury, racking up enormous long-term debt.  They spent money like tomorrow would never come, but yesterday tomorrow came.  Bloated pensions are just another form of deficit spending: commitments given to today’s workers, without worrying about who’s going to pay the bills when they come due.  At some point, the spendthrift government can’t borrow enough money to keep the shell game floating any more.  Who wants to buy bonds from a city that’s talking about 90 percent haircuts for creditors?"

Mr. Hayward continues:  "All of a sudden, the politicians who spent decades assuring their constituents that debt and deficits are no big deal throw up their hands, declare nothing can be done to escape the fiscal black hole they’ve created, and retire to their lavish estates.  Detroit is end-stage Obamanomics."
SOURCE: http://www.humanevents.com/2013/07/19/detroit-goes-bankrupt/

So.  We watch the dance in DC take shape, over the weeks and months ahead, as the democrat controlled government figures a way to bail out Detroit without appearing to bail out Detroit.  Then, we watch as one municipality after the other lines up at the trough until the entire country goes the way of Detroit.
But, HEY!  This is redistribution of the wealth.  This is Obama's socialism.  I seem to recall having mentioned in the weeks, months, and years past that the end result of socialism is always the collapse and death of the host country .  It never fails.

"The Detroit death spiral is Democrat corruption, which drives people out of the city, which leaves fewer taxpayers to finance the next round of Democrat corruption."
-- John Hayward/Human Events  http://www.humanevents.com/2013/07/19/detroit-goes-bankrupt/

This is a sad story but it is not unexpected -- well, it is not unexpected by conservatives, who've been predicting it for decades.  And -- just as we've been proven correct about Detroit, unfortunately, we will be correct about the financial collapse of the United States. I take no joy in saying that -- at all.

FBI Discriminated Against Disabled Veteran Federal Lawsuit Claims

Teresa Carlson

A federal lawsuit filed by Army veteran claims the FBI disqualified him from becoming an agent due to his disability.

By H. Nelson Goodson
July 22, 2013

Alexandra, Virginia - On July 29, a trial is set to start involving the Federal Bureau of Investigation (FBI) and former Milwaukee FBI Special Agent in Charge Teresa Carlson in a lawsuit filed by Army veteran Justin Slaby, 30, who claims the FBI disqualified him from the academy due to his handicap. Slaby of Wisconsin had served two tours in Afghanistan was injured in an Army training camp in Georgia when one of his hands was blown off. While he was in the FBI academy, several training instructors in Quantino, Virginia decided that Slaby was unfit to become an agent due to his disability.
FBI agent Mark Crider, Slaby's weapons instructor disagreed with the other instructors because Salby could use and fire weapons with his dominant hand. Carlson allegedly met with Crider and adviced him that it would be for his best interest to take the side of the government in the case, which Crider disagreed and alleged that Carlson was attempting to coerce him into lying.
Last month, Carlson failed to testify in court regarding the case and cited she was being investigated by the Office of Inspector General and needed an attorney.
On July 18, U.S. Magistrate Judge Ivan D. Davis sanctioned the government for the conduct that Carlson and other FBI officials have taken in the case, the AP reported. The judge wrote it would be up to the jury to determine, if Carlson attempted to get Crider to commit perjury. But Davis determined that Carlson did meet with Crider about his testimony, according to AP.
Carlson was temporarily reassigned to the Washington, D.C. FBI office pending the outcome of the case and internal investigation.

Trayvon Matin: the aftermath

Trayvon Matin: the aftermath

Trayvon Martin: the aftermath

America’s conscience was awakened the day George Zimmerman’s six member jury found him innocent. A properly empowered jury of six women heard reams of evidence from both sides of the aisle and decided for the defense. Vindication of Zimmerman may have been a pyrrhic victory. A diverse group of individuals has concluded Zimmerman is guilty by fiat. Many who claim to speak for the Afro-American community deny the results of this trial as an invalid representation of the facts and call for further justice for the deceased Martin. Tens of thousands are crying out that Martin’s Civil Rights were violated. Investigations by numerous law enforcement authorities in Florida found no basis for the claim. Federal Bureau of Investigation explored the possibility the shooting was race based. After an extensive inquiry they found no element of racism could be attributed to Zimmerman’s interlude with Martin. Eric Holder, the federal Attorney General, was not moved by the jury’s verdict or the multiple investigations relinquishing Zimmerman from racial motivations. Holder’s Department of Justice has opened its own investigation to appease a contingent of people who survive on keeping racism alive amongst their flock. These masters of rhetorical nonsense have called for protests throughout the country to reconcile the jury verdict with the reality they believe actually happened. To spike the flames of racial hatreds further President Obama has thrown himself into the mix. His contorted statements drive home the fact that he questions the legal basis of the verdict. Numerous arrests, some caused by violent acts, have occurred in many jurisdictions. A more profound issue is media management of this debacle. Misrepresenting elements of the Zimmerman case were the norm in left-wing media outlets. NBC doctored voice recordings of Zimmerman to give the impression racism was a key element  the night Trayvon was killed. Overwhelming evidence moves the subject in another direction. Eric Holder’s intervention provides another glimpse how the Justice Department bases its decisions on community emotions not facts. In the event Holder’s Department of Justice manufactures a Civil Rights case against Zimmerman, it will be Zimmerman’s Civil Rights on trial not Trayvon Martin’s. If this case comes to fruition, Eric Holder should be the next person to be placed on trial for subverting clearly written law. Ryan Braun, Milwaukee Brewers Star Player Suspended Without Pay By MLB

Major League Baseball Commission suspended Milwaukee Brewers star player Ryan Braun in connection with the MLB illegal doping scandal.

By H. Nelson Goodson
July 22, 2013

Milwaukee,  WI - On Monday Ryan Braun, one of the Brewers star player met with teammates before their game and discussed his decision not to appeal his 65 game suspension. The Major League Baseball (MLB) Commission decided to suspend Braun for the rest of the season without pay in connection with the MLB illegal doping scandal.
Braun in a released MLB statement says, "I wish to apologize to ...all of the baseball fans especially those in Milwaukee, the great Brewers organization, and my teammates...I realize now that I have made some mistakes. I am willing to accept the consequences of those actions." Braun's statement was posted on the MLB Twitter account.
Tony Bosch, founder and operator of the Biogenesis of America, an anti-aging clinic had met with the MLB Commission and provided documents indicating phone orders and shipments of performance-enhancing drugs to 21 players suspected of taking them.
Bosch also testified against Milwaukee Brewer Ryan Braun, Yankee star Alex Rodriguez (A-Rod) and 19 other players in the league for taking performing-enhancement drugs.
Rodriguez is waiting his suspension as well, which evidence against him is more incriminating than Braun's. The other players are also facing up to 100 games suspensions.

The following article from the opinion pages of the liberal Los Angeles Times is without need of  further comment.

By David A. Lehrer and Joe R. Hicks - During the week since the acquittal of George Zimmerman in the death of Trayvon Martin, the responses to the tragic event, the trial and the verdict have been predictable.

That an unarmed youth lost his life and the perpetrator of the act walked free catalyzed angry and sometimes violent street protests. However unfortunate, that is hardly surprising. The legal nuances of second-degree murder, manslaughter, evidentiary rules and jurors' decisions don't often penetrate through the fog of the 24/7 news cycle. Many people inevitably respond to headlines and passion. There also have been some reasonable discussions of the propriety and impact of "stand your ground" laws and whether Florida's played a role in the verdict.

What isn't reasonable or appropriate is the hysterical response of some civil rights leaders and advocates who have peddled a dishonest and hyperbolic analysis of the tragedy. Unfortunately, their message has been repeated ad nauseam and has become the settled wisdom for some: Young black males are at physical risk in this country, and it is the bigotry of whites that has put a target on their backs.

Jesse Jackson said last year that blacks were "under attack.… Targeting, arresting, convicting blacks and ultimately killing us is big business." Last week he said, "A wave of nameless fear is gripping our country." The musings of Martin Luther King III and the Rev. Al Sharpton echoing the same theme — America is a dangerous place for young black males — have been widely reported. Benjamin Jealous of the NAACP warned that black youth be advised on how to dress and talk, and talked of how hard it is to tell them to be "timid about asserting" their freedom. Tavis Smiley opined that the verdict was "just another piece of evidence of the incontrovertible contempt that this nation often shows and displays for black men."

We received a newsletter from an African American civil rights lawyer who wrote about walking into a convenience store last Saturday night: "Wow. All these people have heard the verdict. Do they now think that I am fair game? Will someone hurt me now that they know that Zimmerman walked?"

What is so insidious about this message of victimhood and division is its dishonesty. Despite the tragic death of Martin under circumstances that no one will ever know the true nature of, there is no "big business" of killing blacks in America. There is no wave of bigotry directed at blacks. All this talk is demagogic posturing, and it's dangerous. Young people will absorb this message and view the "other" with suspicion and fear.

These leaders know, even if many of their adherents might not, that the biggest threat to the lives of young blacks is other young blacks, not white bigots. Between 2000 and 2010, 4,607 black murder victims 17 or younger were killed by other blacks (4,441 of the killers were 17 or younger), according to the Wall Street Journal. There were 340 black victims 17 or younger killed by (non-Latino) whites. That means black youths were 13 times more likely to be killed by a black person than by a white one. {Read More}

Panama Gov't Confiscated 2 MiGs, Missile Radar In Addition To Missile Parts On N. Korean Ship

North Korean ship attempted to smuggle missile parts, 2 MiG-21 fighter jets and missile radar equipment in hidden containers through the Panama Canal, Ricardo Martinelli, President of Panama reported.

July 22, 2013

Panama - On Sunday, Ricardo Martinelli, President of Panama reported, that the N. Korean ship that was caught attempting to smuggle several missile parts through the canal, also had 2 MiG-21 fighter jets and missile radar equipment in hidden cargo containers under thousands of sacks of sugar. The Cuban government notified Panama that the ship was transporting donated sacks of sugar to N. Korea, but the ship was emptied and officials smelled a strong odor of jet fuel and found the MiGs hidden in the ship. The jets and missile equipment in addition to several containers with missile parts were reported to the U.N. Security Council and the U.S.
It's illegal to transport hidden military equipment and arms through the canal. Transporting arms without declaring them is also illegal, according to Panama officials. They have requested for the U.N. to investigate the seizure of military arms headed to N. Korea.
N. Korea has demanded for Panama to release the Chong Chang Gang ship, its captain and 33 crew members who have been arrested for attempting to smuggle undeclared weapons. Panama has not released any of the crew or captain who attempted suicide after the missile parts were discovered.
On July 15, Panama officials confiscated containers of missile parts from a North Korean ship trying to go through the Panama Canal. The ship had left Cuba and authorities in Panama believed it was attempting to smuggle drugs after they noticed that the ship captain became angry and the crew rioted.
The ship was taken to an inspection section in the canal where officials discovered the missile parts under a sugar cargo.
Last week on Monday, Martinelli, President of Panama posted several photos of the missile containers on his Twitter account and announced that the military parts were found inside the cargo ship.
Martinelli said, drug enforcement officials had spotted the ship after it left Cuba and supected it was carrying drugs. No drugs were found in the ship.

Gun Owners: Stand Your Ground! ... J. D. Longstreet

Gun Owners:  Stand Your Ground!
Tried By 12 Or Carried By Six?
A Commentary by J. D. Longstreet

****************

"Never let a crisis go to waste."  That is not only the motto of the Obama Regime, it is also their "watchword."

The dictionary defines watchword as:  "A word or phrase expressing a person's or group's core aim or belief."

The Obama Regime's singular dexterity in creating crises and then employing the confusion and distraction from those crises to advance their Marxist agenda is unmatched in the history of US politics.

They don't seem to much mind what, exactly, the crisis is ... even the wholesale slaughter of little children.

Obama, still worried that Americans have guns and present a formidable obstacle to a leftist dictatorship in America, remains wed to the idea that those Americans who "cling to guns and God" must be neutralized in one way or another.

Since Congress refused to violate the US Constitution for him, he continues his search for ways, any way, he can -- at least -- reduce the perceived threat from American gun owners.

He thinks he has found one.  The "Stand Your Ground" laws in some 30 states.  If he can get the judiciary to find those laws unconstitutional, he advances his Marxist agenda.

There will be hell to pay overturning those laws in the south.

We have an expression here in Dixie.  I'll clean it up and paraphrase it for you:  "A burglar may walk into my house, but he, sure as hell, WILL be carried out!"

We call it broadly: The Castle Law or the Castle Doctrine (Defense of Habitation Law). In some states the Castle Law extends to any legally occupied space including one's vehicle and/or one's workplace.   Simply put, it means that every man's home is his castle and he has a God-given right to protect it -- and those within it -- with whatever force may be necessary without fear of repercussions from the law.

"Stand Your Ground" means you no longer have to turn tail, as a coward, and run from an intruder.  You no longer have the legal obligation to "retreat." You can confront him, like a man, and protect your life, the lives of others, and your possessions.  If lethal force is necessary to subdue the miscreant, then so be it.

Some years ago, a southern state with a democratic party controlled legislature took that right away from it's citizens and installed the "obligation to retreat" as state law.  It lasted only until cases began going before juries in the state and those juries flat-out refused to convict anyone brought before them for defending their homes and possessions.  One jury even refused to deliberate telling the judge, respectfully of course, that they believed the law, itself, was illegal and they would not convict anyone for breaking an illegal law.

It didn't take many months for that same state legislature to overturn their new law and reinstate the Castle Doctrine as law in the state.

Now, Obama wants to overturn the Castle Doctrine/Stand Your Ground laws in the entire country.  See, he can't take our guns, but if he can create a situation in which we gun owners cannot use them without breaking the law, he has, at least partially, attained his goal.

It's called incrementalism -- a "little bit at a time." That's how America became a socialist nation -- a little bit at a time.

The folks at the Justice Department surely know they have a snowball's chance of bringing a successful case of violation of civil rights against Zimmerman.  In my estimation, that is only the distraction they will use while they burn the midnight oil to find a way to abolish the Castle Doctrine and Stand Your Ground Laws in the US.

Come on, folks!  The concept of a man's home as his castle dates all the way back to the time of the Roman Republic.  We Americans brought it over from England as we borrowed it from the historic English Common Law dictum that "an Englishman's home is his castle." It was established in English Common law in 1628. Originally it was meant to imply a person's absolute right to exclude anyone from his home.  Of course, the modern day version DOES have exceptions.

I found this article to be particularly interesting, as well.  Consider the following: "The American interpretation of this doctrine is largely derived from the English Common Law as it stood in the 18th century. In Book 4, Chapter 16 of William Blackstone's Commentaries on the Laws of England, he states that the laws "leave him (the inhabitant) the natural right of killing the aggressor (the burglar)" and goes on to generalize in the following words:

And the law of England has so particular and tender a regard to the immunity of a man's house, that it stiles it his castle, and will never suffer it to be violated with immunity: agreeing herein with the sentiments of ancient Rome, as expressed in the works of Tully; quid enim sanctius, quid omni religione munitius, quam domus unusquisque civium? For this reason no doors can in general be broken open to execute any civil process; though, in criminal causes, the public safety supersedes the private. Hence also in part arises the animadversion of the law upon eaves-droppers, nusancers, and incendiaries: and to this principle it must be assigned, that a man may assemble people together lawfully without danger of raising a riot, rout, or unlawful assembly, in order to protect and defend his house; which he is not permitted to do in any other case.
—William Blackstone, Commentaries on the Laws of England

Not only was the doctrine considered to justify defense against neighbors and criminals, but any of the crown's agents who attempted to enter without a proper warrant as well. It should be noted that prohibitions of the Fourth Amendment to the United States Constitution share a common background with current castle doctrine laws."

Each state differs in the way it incorporates the castle doctrine into its laws, what premises are covered (abode only, or other places, too), what degree of retreat or non-deadly resistance is required before deadly force can be used, etc..

Here in North Carolina, the Castle Law is clear as a bell.  "North Carolina's Castle Doctrine protects people in their home, workplace or automobile. It allows a person to use defensive force, including lethal force, if they have a reasonable sense of fear of serious bodily harm in their home, workplace or car. North Carolina law does not require the person to retreat before using deadly force.

The law presumes that "a person who unlawfully and by force enters or attempts to enter a person's home, motor vehicle, or workplace is presumed to be doing so with the intent to commit an unlawful act involving force or violence."

The law goes on to read, "a person is justified in the use of deadly force and does not have the duty to retreat in any place he or she has the lawful right to be if either of the following applies: he or she reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself or another." There are a few states with what is known as "Make My Day Laws."  "The specific conditions of the Make My Day Law are that an invader has made unlawful entry onto the property, that there is a reasonable belief the invader is or intends to commit a crime on the property, and that there is a reasonable belief the invader may use physical force himself. If these conditions are satisfied the immunity applies, and no verbal warning must be issued. Though again, it varies by jurisdiction, in most cases the presumption of innocence rests with the property owner in being justified.

Some states go even further and make it legal for such stand-your-ground laws to apply outside of one's home. Florida is one such state, where an individual may use deadly force when assailed at any location he has a right to be. As of 2010, more than 30 states in the US have some degree of Stand Your Ground Law."

Note:  These are ALL STATE LAWS passed by the people of the states.  And yet, our federal authorities are searching for a way in which the federal government can squash those laws, which reflect the will of the people of those states.  The power grasping of the Obama Regime seems to know no bounds.

Again, the fall back of American gun owners is the 2nd Amendment.  Each time the government announces, or in anyway demonstrates their desire to infringe upon those 2nd Amendment rights, gun owners "cling" a little tighter to their weapons.  So far, the Obama Regime has been the best salesman for gun dealers in America since,  well, EVER!

As a friend reminded me recently: "The left is relentless."  They're not going away and they are not about to stop their quest for America's guns.   Going after the Castle Doctrine laws, and the Stand Your Ground laws, and the Make My Day laws is simply attacking from another direction.

Regardless of how it all plays out, in the end when one awakens at 3 AM to sounds of uninvited miscreants rummaging through his things, and he quietly takes his 50 caliber Desert Eagle from the drawer of his bedside table, the one question uppermost in his mind will continue to be:  "Is it better to be tried by 12 than carried by six?"
