As the Police State Continues To Grow In America...

William H. Pauley III, a federal judge of the United States District Court for the Southern District of New York has ruled "... that protections under the Fourth Amendment do not apply to records held by third parties, like phone companies." This of course means that all phone records essentially become the property of the federal government and can be used for any reason whatsoever Big Brother deems appropriate. It certainly seems America is rapidly approaching the government described in George Orwell's epic novel 1984. Big brother will not be content until it can listen to and see everything its citizens are doing.

Nominated by President William Jefferson Clinton in 1998 to the federal bench Judge Pauley's decision is somewhat befuddling. Especially in light of Judge Richard J. Leon of Federal District Court for the District of Columbia ruling that "... the program most likely violated the Fourth Amendment. As part of that ruling, Judge Leon ordered the government to stop collecting data on two plaintiffs who brought the case against the government." Judge Leon, nominated by President George W. Bush in 2002 clearly understands the dangers to Americans right to privacy and the concept of unlawful search and seizure. Essentially data mining of private phone records by the NSA of United States Citizens is an unconstitutional act and Jfge Leon has it exactly right.

What befuddles me even more is that the current "President of the People", Barrack Hussein Obama, apparently is solidly behind the decision handed down by Judge Pauley. An Obama Justice Department spokesman had this to say following Judge Pauley's decision, " “We are pleased the court found the N.S.A.'s bulk telephony metadata collection program to be lawful.” The spokesman refused further comment. Welcome Big Bother Surveillance State of America.

The ACLU, of whom former Republican President George Hebert Walker Bush as a proud card carrying member of, intends to appeal the decision. In a statement following the decision Jameel Jaffer, the A.C.L.U. deputy legal director made the following statement, "... We are extremely disappointed with this decision, which misinterprets the relevant statutes, understates the privacy implications of the government’s surveillance and misapplies a narrow and outdated precedent to read away core constitutional protections.” This is most certainly one issue that ALL Americans should be highly concerned with.

Extolling the virtues of failure as he moves through his day, President Obama’s success can be measured in the number of lies he spews hourly. Democracy is no longer an essential theme for an Administration that has undermined every institution, industry and tradition in the country. Instead their sole purpose for being is to control every aspect of its citizenry’s existence. To bring this goal to fruition the Obama Administration has set out on a path of deceit so profound that it startles even their most staunch supporters. Worse, when the lies are revealed the massive cover up begins. Choose your topic: the massacre in Benghazi, Obamacare, Fast and Furious, the IRS assault on conservatives, fraudulent use of taxpayer funds are just a few of the insidious actions taken by an out of control Executive branch. America no longer functions by law, fiat has become the vehicle of control to implement the President’s agenda. Every wrongful action committed by the President has been submerged using chicanery to inhibit full disclosure of its intent and outcome. Most recently President Obama has utilized a variety means to deceive the public about key elements of Obamacare. America has only tasted the bitter fruit of phase one, the insurance exchanges. With their failures reported in all fifty states the Administration has maintained one script which obviates the truth. Obamacare’s basic algorithms are flawed, which is no surprise to the public who has to deal with them. Failure has been the core theme threaded throughout President Obama’s virtual usurpation of American culture, rhythms and infrastructure. He has misled tens of millions that the road to their futures depends on the work of others, not their own. With well-rehearsed demagoguery Obama appeals to his audiences’ weaknesses with the intention of retaining his power base. Hypocrisy is the new Democracy, left unchallenged, will become the template for future Administrations. For now a lame Congress and a left leaning Supreme Court have done little to impede America’s departure from Democracy. Perhaps the Administration should take a lesson from the Old Testament: thou shall not bear false witness against thy neighbor. Yet, I believe they are too busy planning their next cover up.

It's looking pretty good lately but let's really get into the details. And when I say pretty good, I mean that it isn't actually crashing again right now (even though it appears to be fully primed for another crash).

Note the increasing amplitude of the vibrations. In the next chart, let's just look at the absolute value of the quarterly change. This will give us the magnitude of the increasing chaos that is clearly evident in the system.

I will end with some good news and bad news.

First, the good news. The chaos appears to be receding.

Now, the bad news. Is it actually receding or does it just appear to be receding? Over the short-term? Over the long-term? Who knows! I have doubts. I believe that the tank-slapper is being managed with illusionary and unsustainable dampening. What we can't see yet, can't hurt us yet! It's the modern and financially innovative ostrich effect!

This Year’s Battle over Mark-to-Market Versus Mark-to-Model Accounting Was Worth the Fight

FSP FAS 157-4 relates to determining fair values when there is no active market or where the prices being used represent distressed sales. It reaffirms that the objective of fair value measurement is to reflect how much an asset would be sold for in an orderly transaction (as opposed to a distressed or forced sale).

There's only one thing that determines value better than the free markets. That's a group of corporate executives tweeking financial models as they look to enhance the value of their stock options. Risk on, baby! Risk on!

Too bad we can't apply this same concept to home sellers. I know that you are only willing to pay $150,000 for this house but my economic model clearly shows that it is worth $300,000! You just need to be patient until the economy returns to its "orderly" peak again!

This post once again inspired by Rob Dawg's tank-slapper concept (as seen in the comments of previous posts). I went looking for an epic tank-slapper chart that could really do it justice today. Found one on my first attempt. I didn't even have to call a personal astrologer. Go frickin' figure.

Paul Edward Tate Pasadena teacher romantically involved with student


Reports of a man on a date with a young girl wearing a school spirit shirt have led to felony charges against a Pasadena Memorial High School teacher, according to Harris County court documents.

Paul Edward Tate, 36, has been charged with having an improper relationship with a student and indecency with a child over a relationship he allegedly began in October with a 16-year-old female at the school.


According to Harris County records, Tate and the teen were seen at various eateries in Pasadena and Tate had showered her with presents, including jewelry, a purse, and clothing. A witness reported seeing the pair at an Olive Garden location earlier this month on what appeared to be a date. Tate and the student seemed open about the relationship, walking arm in arm into the restaurant, according to court documents.

Officials said Tate previously had been warned by an assistant principal at the school to stay away from the student after seeing them together in October at a McDonald's. Records state that the assistant principal saw Tate purchase a $200 Pandora bracelet for the student, though Tate said he was purchasing it for his mother.

During an interview with the student, court documents show, a Pasadena Independent School District Police Department officer noticed the student wearing a bracelet matching its description.

PISD police officials obtained the phone records of both Tate and the student and discovered that a number of text messages, photos and phone calls between the two, which indicated that there had been sexual contact and intercourse involved in their relationship. According to court documents, the student also sent Tate photos of herself in lingerie.

Pasadena Memorial High School and the Pasadena ISD Police Department weren't able to be reached for comment on Friday morning.

According to the Harris County District Attorney's Office on Friday, Tate has not been arrested and is scheduled to appear in court on Monday.

Monday, the Fairfield Board of Education suspended science teacher Gil Voigt. He has 10 days to request a hearing before the school board or a referee.

The Sinaloa department of justice confirmed that Olaguez-Rendon had been extradited to Mexico on October 4, to face mulitple homicide charges.

Sinaloa, Mexico - Genaro Olaguez-Rendon, 53, was extradited on October 4, to Mexico after the U.S. Marshals Service arrested him at a family home at the 2500 block of Grove Ave. in Sacremento, California. The U.S. Marshals Service took Olaguez-Rendon into custody on October 3 after Mexico had requested an extradition order for his arrest in connection with the homicides of eight Sinaloa state officials including a commissioner and resulting with four other officials being injured on May 2, 2000.
After the murders, Olaguez-Rendon fled Mexico and illegally entered the U.S. He worked as a landscaper for almost 13 years in the San Joaquin County using false identities. Olaguez-Rendon was arrested in April for cultivating marijuana and for maintaining several growhouses around Stockton. He spent three months in jail, but was released afterwards due to jail overcrowding. 
Olaguez-Rendon was also wanted on a felony charge for failing to appear at an April court hearing concerning the marijuana growing charges.
He currently has a pending case in San Joaquin County for cultivating marijuana and stealing public utility services to grow marijuana, according to court records.

Former New York mayoral candidate Anthony Weiner has used social media to hint at a comeback.

The politician, whose embarrassing sexting scandals saw him resign from Congress in 2011 and lose the mayoral election this year, wrote on his Facebook page that he 'hopes to keep the band together.'


'What's next? I'll keep you posted on my plans. But I hope we keep the band together,' he wrote, noting that 2013 'didn't go as I had hoped.'

The democrat became a national joke after explicit images he sent to various young women under the alias 'Carlos Danger' became public.

He was called on by the New York Times editorial board, among others, to leave the mayoral race but stayed on until the end, securing 4.9 per cent of the vote.

New York Soon to Trail Florida in Population

ALBANY — New York, whose status as the most populous state has long fourth place, a long-anticipated drop that is rife with symbolism and that could carry potentially serious economic consequences in coming years.

When the Census Bureau releases its latest population estimates on Monday, demographers expect that Florida and New York will be narrowly separated — perhaps by as little as a few thousand people — and that if Florida does not pass New York this time, it almost certainly will do so in 2014.
The census figures underscore immigration trends, as foreign-born migrants continue to move to warm-weather states such as California and Texas — No. 1 and 2 — as well as to Florida. The newcomers also include winter-weary New Yorkers who move or retire to Florida at a rate of over 50,000 a year, twice the number of Floridians who head to New York.



But the shift also highlights the struggles in upstate New York, which has lost large-scale manufacturing jobs and large chunks of population, offsetting consistent gains in New York City. But the city’s growth has seemingly not been robust enough to stave off hubs in Florida like Jacksonville, Miami-Dade County and Tampa.

“It’s going to happen,” said Andrew A. Beveridge, a professor of sociology at Queens College and an expert on the census, on New York’s falling into fourth place. “And if Florida accidentally grew faster and New York slowed down, it could have happened already.”
Beyond a blow to New Yorkers’ collective ego, the changing population pattern could have many practical and political implications, including diminished congressional delegations, a setback New York already suffered in 2010 — the year of the last decennial census count — when the state lost two districts, while Florida gained two seats. Census data also inform how billions of dollars in federal funding and grants are divvied up among the states, for things like highway planning and construction, public aid for housing and health care and education programs.
All of which has Florida feeling good.

“Every number we see, if we don’t pass them this year, we’re going to pass them in the next few months,” Gov. Rick Scott of Florida, a Republican, said in an interview last week. “Florida’s on a roll.”

A closer look at the numbers shows that New York is not actually losing population. It has been growing at about 1 percent annually of late, but it simply cannot keep up with Florida’s rate of growth, which was about 2.7 percent between April 2010 and mid-2012, according to the Census Bureau. However, New York’s population is declining in upstate cities like Buffalo, which has lost more than 10 percent of its population since 2000, as well as places like Syracuse and Rochester, where population is largely stagnant.
Turning around upstate has been a major focus of Gov. Andrew M. Cuomo, a Democrat, who has tried to revive its fortunes through a variety of economic development programs, including the legalization of more casinos and a program that allows businesses to start or relocate on or near college campuses and pay no state taxes for 10 years.
Florida has actually been creeping up on the Empire State for decades. The last census estimate, for July 2012, put the states nearly tied: New York with 19.6 million and Florida with 19.3 million. But that margin was getting narrower by the day, according to Jan K. Vink, a specialist with the Program on Applied Demographics at Cornell University, which both supplies data to the Census Bureau and reviews its estimates.
Scott Cody, a demographer at the University of Florida’s Bureau of Economic and Business Research in Gainesville, which also consults with the bureau, said that trends showed Florida passing New York “in the near future,” barring what he called “the unusual events that can occur: tsunamis, or asteroids, and total economic breakdown.”
Florida had such a meltdown — a bursting housing bubble — but is on the rebound and continues to be a magnet for new arrivals.
While demographers tend to stay neutral on the issue of population growth, they say that bigger is generally better because it tends to reflect an attractive economic climate.
“Once you have a growing economy, you tend to attract a lot of young people,” said Mark Mather, a demographer with the Population Reference Bureau, a nonprofit research group in Washington. And that, in turn, he said, means “a lot of babies.”
New York City certainly still attracts young people, Mr. Mather said, “but the city is different from the state.”
However, bigger is not always better. While politicians might welcome the larger tax bases that come with bigger populations, demographers say a need for more services increases. More populous places also have more congestion on highways and more wear-and-tear on public spaces.
“Just because one state is passing another, it’s not a good or a bad thing,” Mr. Cody said. “It doesn’t mean one state is better than another.”
But Mr. Scott said he believes that a large part of Florida’s appeal has to do with its pro-business, low tax approach. Florida also has no personal income tax.
And then there is Florida’s decided climatological edge, which attracts both retirees and those still in the work force, he said.
“When I call on companies around the country, I clearly talk to them about what the weather’s like,” Mr. Scott said. “I say, ‘Oh it’s 40-what?,’ and I joke, ‘I’ve got to turn down the air conditioning so you can hear me.’ ”
Gov. Cuomo pointed to his tax-free campus plan, known as Start-up NY, as an example of how “it’s less expensive for businesses to locate in New York State.”
And as for the weather, Mr. Cuomo said he was happy with New York’s. “Florida and the South have a warmer climate if that’s what you prefer,” he said. “I prefer to have seasons.”

The crowd was roaring.  The lone man in his impeccable tan colored uniform would step forward toward the lectern, then pause and let his eyes wander over the thousands of up turned faces -- all staring at him, waiting for him to speak. And they waited -- and they waited. 

The man at the lectern made no effort to speak.  He just stood there, almost motionless, and didn't say a word.

A wave of anxiety, nervousness, began to sweep through the crowd of expectant listeners. The noise level began to recede.  Soon the roar of the crowd was gone completely.  The crowd became quiet and motionless, a reflection of the man they had come expecting to hear speak.

A full sixty seconds would expire before that man would take the one remaining step to the lectern,  and begin speaking. 

At first he spoke softly forcing his audience to strain to hear his words. Quickly they were leaning forward, heads cocked, hands cupped behind ears in rapt attention, desperately seeking to hear every word, every syllable, every breath, and lay claim to the wisdom his words would impart.

Then little by little he would increase the volume of his voice until finally he was shouting and gesticulating in a near maniacal manner.  His audience was worked up to a fever pitch ready and willing to do his bidding, no matter the consequences.

Those of you reading this now, if you are near my age, know exactly of whom I speak -- Adolf Hitler.   He was a master at oratory.  He was a master actor. He was a master at manipulating his fellowman.  He was a master at dealing death and destruction. He was a master at destroying nations -- and -- nearly destroyed the world. 

Watching a film clip of one of his speeches today sends chills racing up and down my spine.  It is as though just the sound of his voice invokes evil.

He was, quite likely, the greatest orator of the 20th century.

Here in the 21st century, we have another great orator.  He, too has to power to move his listeners to act while disregarding consequences.  He, too, has worshipers -- some who even refer to him as "Lord and Master."

His Name is Barack Hussein Obama.  And he is President of the United States of America.  And he scares the hell out of me!      

If you look at the faces in one of Hitler's crowds and compare them to the faces in Obama's crowds, you will see the same worship of their speaker.  But look closely.  Look at the eyes.  Do you see it?  Do you see the vacant, "the lights are on, but nobody's home" look reflected in those eyes?  It's the look that makes those tiny little hairs on the back of your neck tingle and stand up.  That's primal fear, honed to perfection by our ancestors while they still lived in caves. 

Trust it. It is telling you:  "Something is dreadfully wrong."

If you could look BEHIND those blank stares, I feel certain you would see something else, too. Raw fear.  It's the sane part of the human mind fighting to regain control.  Worshipers always fear -- and eventually begin to question.

Given a choice, I will not listen to an Obama speech.   I get the same feeling I would get if told the Battle of Armageddon had begun. Bells and whistles begin going off in the Amygdala of my brain, the part of the brain that controls one's "flight or fight" reaction.  That's our caveman ancestors banging on our door in the middle of the night yelling "FIRE!"

Be afraid.  Be very afraid.  No mere mortal should have that kind of power over his fellow human beings.  It is too easily misused.  It is raw power -- and it is corruptible.

Obama's speeches are chilling to me ... almost malevolent.  It's as though he is using his voice, his tsunami of words, to misdirect the gaze of his worshipers away from all that is not right with America toward a utopian facade of an America that, in reality, does not exist -- and never will.

Encouraging worshipers is never a good idea for mere mortals.  As we said above, worshipers will eventually begin to ask questions.  Sooner or later they will ask the RIGHT question and receive the true answer.  At which point the "worshipee" is in deep trouble.  That mindless crowd can turn on a dime and produce pitchforks and torches that light the night in hate and violence -- all directed at the one who deceived them. History is replete with records of just such behavior played out time and again.  The fate of Benito Mussolini springs instantly to mind.

Often less is, indeed, more.  My father was a man of few words.  As a result, when he spoke, the family listened. We knew that even though he did not speak often, when he did -- it was important -- and usually well thought out.  When he had finished, he had finished.  No force on earth could change his mind.  I admired that, growing up as a lad, and I still do.

As I have grown older I have noticed that my world has been slowing down while the world around me has shifted into hyper drive.  The voices I hear from the hyper drive world now are loud, reverberating, penetrating, harsh, crude, insistent, and aggravating. And I am continuing to learn how to shut them out and listen for that "still, small, voice" of authority (1 Kings 19:11-13 -- The Old Testament) asking:  "What are YOU doing here, J. D.?"

It would seem that we have not yet learned that the answer is not carried upon the waves of loud flowery oratory regaling us,  and misdirecting us, with all the right "answers" to all our problems.  Instead, it is within moments of quiet introspection when the still small voice is heard -- just above a whisper -- but with the gravitas of endless universes.

18-year-old Chicago Man Charged For Christmas Day Decapitation Homicide

Chicago, IL - On Thursday, Alexis Valdez, 18, was charged with murder in connection with the early Christmas Day discovery of a decapitated body of Silvestre Díaz-Hernández, 41. Police were called around 2:00 a.m. to a Belmont Gardens neighborhood apartment where Díaz-Hernández was found in the basement at his apartment located in the 2500 block of North Kildare Ave.
Valdez within minutes was taken into custdy near the apartment without incident and charged with first-degree murder. Police recovered a knife believed to have been used by Valdez to murder and decapitate Díaz-Hernández.

I am so pleased this afternoon. Following a very enjoyable luncheon with none other than my ever engaging and intuitive as well as highly intelligent better half I came home to find Karl Rove's report on his 2013 predictions. A real treat if 1)you're a republican or 2) you happen to be in the mood for a chuckle. Something the "White Chalk Board Man" never fails to provide.

Mr. Rove, the dude that has successfully built and or maintained the current GOP box the faithful find themselves locked into gave a brief but informative who-ah for himself on 2013 and as well as his 2014 predictions. A veritable treat if ya have some time to waste.

It seems Pope Francis has the GOP is a twist. I can understand this because the Pontiff, being the head Theologian steeped in education and the pursuit of Mysticism really hasn't a clue when it comes to economics, business, or how to run anything other than the Church. Supposedly a purely altruistic and spiritual pursuit.

On the other hand we have the ex Randian (for political reasons he later denounced Objectivism) Representative Paul Ryan talking about capitalism and how the Pope, who hails from Argentina, doesn't understand capitalism because all Argentinians have known is crony capitalism. Fair enough. Let us take a look at the definition of crony capitalism and see how it all plays out shall we?

Crony Capitalism - An economy that is nominally free-market, but allows for preferential regulation and other favorable government intervention based on personal relationships. In such a system, the false appearance of "pure" capitalism is publicly maintained to preserve the exclusive influence of well-connected individuals. (Source)

Oops! Looks as though a future (well connected) potential Republican candidate for the presidency of the United States of America has just described, here it is... the U.S. economy and its crony "Capitalists."

A False Sense of Securities

The following chart shows a smoothed version of 5 year annualized real S&P 500 growth (the index is adjusted for inflation as seen in the CPI).

Each data point in the chart is constructed by creating an exponential trend over the previous 5 years of data and then using that trend to determine an annualized growth rate over the 5 year period. That's a lot of exponential curve fitting (and smoothing).

For those interested, this is what the cell contents are for that last data point.

Needless to say, I'm thankful that I did not have to calculate it by hand. Good thing we live in a modern and financially innovative age!

Don't worry. It is different this time! In no way am I trying to imply that Sure Thing #3 will end in failure at some point just because Sure Thing #1 and Sure Thing #2 did. Heavens no. Our economy was weakened far too much by the previous two failures for there to ever be a third.

Here's the best part. As seen in the chart, I had to rotate the text for Sure Thing #3 a bit extra. That means Sure Thing #3 is the steepest sure thing yet! To infinity and beyond! What an awesome story! What could possibly go wrong?

Twins prospect Alex Meyer moonlights as substitute high school teacher



Not all athletes are spoiled rotten!

Fox Sports reports not many millionaires would willingly and enthusiastically work a side job that pays them only $63 a day, but Minnesota Twins minor league pitcher Alex Meyer isn’t like most millionaires.

The former Mr. Indiana Baseball winner may earn the big bucks on the diamond, but during the offseason, he chooses to return to his hometown and serve as a substitute teacher in the Greensburg school district -- more specifically, walking the halls he strolled as a teenager: Greensburg High School.

The 6-foot-9, first-round pick out of the University of Kentucky certainly doesn't have to spend his winters telling high schoolers to stop texting, but Meyer enjoys knowing he has a second love that could turn into a career if baseball doesn't pan out.

"Being able to be a substitute teacher puts me in a real-life atmosphere and lets me know if this is something I really want to do or not," he said. "So far, it is."

Two teens 13 and 14 killed, one injured in Christmas night shooting in Newark



The shooting carnage continues in the city of Newark which is gaining a reputation as being known as Little Chicago.  But, that didn’t stop Corey Booker from getting elected senator, did it?


NY Daily News reports two teenagers were killed and another seriously wounded in a shooting late Christmas night in Newark, according to law enforcement authorities.

A 13-year-old boy and 14-year-old girl were shot dead, Newark Police Director Samuel DeMaio and Essex County Prosecutor Carolyn Murray said in a statement to the Star-Ledger.

The shooting took place about 10 p.m. on Schley St., near the Irvington border.
The two teens were pronounced dead at University Hospital, while the third victim remained in critical condition. Their names were not released.
